president joe biden is not backing down when it comes to ongoing ceasefire negotiations in the middle east. we're following the latest as israeli forces buckle down in rafah and all the new warnings from the un about more than 1 million palestinians seeking shelter at a helping hand for farm workers impacted by the deadly half moon bay shooting. the seven figure promise from leaders on the peninsula. this is today in the bay thanks for joining us on this wednesday morning. i'm kris sanchez and i'm chris chmura. let's start with a look at the forecast. meteorologist carrie hall is tracking what we can expect. good morning carrie. good morning. and we are starting out the same way we have the past few days. nice and cool. it's all clear. and as of now, we do have a calm wind and temperatures in around the 50 degree mark. now we're going to see it warmer for this afternoon with our temperature high of 81 in martinez and 79 in novato, san francisco also getting a big

boost today. so we'll be in the mid 70s there and in san jose we'll see a high of 81 degrees. it gets even warmer tomorrow as our highs head for the mid to upper 80s. we'll talk about this warming trend, the high winds and also what's ahead for the weekend. coming up in a few minutes. back to you. thank you carrie. happening today a landmark case in contra costa county is set to play out. four men on trial for murder could be spending a lot less time in prison than reduced sentences because of that racist text messaging scandal involving antioch police today in the bay's tom jensen is live in martinez. tom you say this case is testing the state's racial justice act. good morning, chris, and chris. it certainly is. all four of those men are having their cases adjudicated here in superior court at the contra costa county courthouse in martinez, and all four of them have now taken plea agreements in the 2021 drive by

shooting case where one person was killed and one person was injured. that plea agreement is for pleading no contest to manslaughter charges instead of murder charges. that deal came after the court learned the antioch police officers involved in investigating this case exchanged dozens of racist text messages about the suspects, the discovery prompting the judge to rule the officers, violated the state's racial justice act today. two of those four will be sentenced, the other two on friday. prosecutors say it is the first major test of the state's racial justice law. they also say this won't be the last case where these racist texts scandals are involved. this has been a reckoning for everyone involved and there is no outcome that can ever satisfy anyone. in this case, legal analysts say this truly is the first time

california's racial justice act has been tested. in a major case, they acknowledged the victims families likely won't be happy, and the mother of the victim has already expressed her anger over the latest developments. the suspects, who had originally faced the possibility of life sentences, will face now sentences from 12 years and eight months to 20 years in prison instead of those life sentences, like i said, which is angering the families of the victims. and we heard from some of them last night. we're live in martinez. tom jensen today in the bay. thank you. tom 503 now and developing right now, israeli tanks taking control of gaza's vital rafah border crossing. the un warned of a potential collapse of flow of the of aid to the palestinian people because of that closure in rafah and other main crossings into gaza. right now, the northern part of the enclave is already experiencing a full blown famine. the united states halted a large shipment of weapons to israel last week over

concerns that israel would use those weapons on rafah, where there are more than a million palestinian people sheltering in already dire conditions. and this morning, negotiations continue between israel and hamas with a cease fire and hostage release deal still in the balance. president joe biden is emphasizing the us's ironclad support of israel and also condemning anti-semitism. today in the bay's brie jackson is in washington with the latest in brie we heard the president's message. what else is he saying? good morning chris. so during a holocaust remembrance ceremony tuesday, president biden, he connected the horrors of the holocaust to hamas's attack on israel, the indifference of the world. president biden denouncing the nationwide surge of anti-semitic incidents since hamas attacked israel on october seventh. there is no place on any campus in america, any place in america, for anti-semitism or hate speech or threats of violence of any kind. his

remarks came during a ceremony honoring the 6 million jews killed during the holocaust, and as campus protests against the israel-hamas war continue, republicans criticized the president for not speaking out sooner instead of protecting jewish students, joe biden has pandered to the pro-hamas wing of the democrat party. overseas. israeli military forces seized control of the gaza side of the rafah border crossing with egypt as part of what officials call a very limited ground operation. it wasn't an operation in these civilian areas that they had ordered to be evacuated, so, we will continue to make clear that we oppose a major military operation in rafah. make that clear then, privately as well as publicly, negotiations continue today as israel and hamas try to bridge the gaps between their proposals. the u.s. is pushing for more aid to gaza and a ceasefire to. we continue to believe that there is space to reach a deal. and we are trying,

incredibly hard to push one over the line. president biden says he'll continue to push for peace at home and abroad, and for those held hostage by hamas to come home, just as we have freed hostages already and will not rest until we bring them all home, cia director william burns will be in israel today for the latest round of negotiations. fans in one hamas official says there will be no deal if israel continues aggression on gaza. kris brie. thanks very much. new this morning here at home, one person is dead after a car crash in the south bay. here's what we know chp says around 830 last night, a driver was speeding on 101 north, exited at the trimble road off ramp too fast and flipped their car. the driver died at the scene. the 101 on and off ramps to and from trimble are now back open only on nbc bay area. a south bay family is demanding justice after a stabbing near cinco de

mayo. celebrations left a man fighting for his life. it happened in the late afternoon on sunday near king road in east san jose. the 30 year old man was critically injured. a child there also suffered minor injuries. we are not identifying the victim because the family is in fear of retribution, but the victim's sister wants the people who are responsible to be held accountable. my brother is a real good dad. he's always there for his daughter. he's there for us to where we need favors. he's there. and he's a really good person. i want them to get those people that did this to my brother, because it's not fair. the victim's mother tells us that he is in a coma, and his five year old daughter keeps asking about him. so far, police are saying very little about that investigation. new details san mateo county is set to fund a new housing project for the families displaced by last year's mass shooting in half moon bay, a gunman killed seven

farm workers there. well, last night, the board of supervisors voted to grant nearly $6 million for the project. here's what's going to happen. the money will be used to purchase manufactured homes for farm workers and the 19 families displaced by the shooting will get top priority. at least 28 units of the new stone pine cove neighborhood will be set aside for them. happening today, concerned residents are planning to meet with los gatos leaders surrounding a proposed housing development critics say goes way too far right now. the project calls for a seven story housing development on benedict lane, near the new town shopping center. at this point, the plans are preliminary, but the spotlight reports that it includes more than 200 apartment units, with some 50 units set aside for affordable housing. this would also include a two level parking garage. so the next real step is a formal application, which the developers are expected to file by mid september. all right, now we can give you a live look at

a day later in santa rosa. starting out in the upper 50s at 8:00 at noon. it is already 75 degrees. that's a big jump in temperatures over a short period of time, and we're going to have a much warmer afternoon. we'll get a look at what to expect as these temperatures continue to ramp up. more coming up in a few minutes. and right now we're getting a live look at 880 the nimitz freeway moving very smoothly, those headlights heading south past our camera and tesla in toward the south bay. and i guess on that note,

chris, we'll hand it over to you. yeah. speaking of fremont, investigators are digging deeper into tesla's autopilot feature. federal safety investigators published a letter to the company. they are asking tesla for data on how it's trying to make its autopilot safer. the tech is linked to nearly 470 crashes and 41 deaths. the company recalled 2 million vehicles back in december to issue an online software update. well, now the national highway traffic safety administration wants to know how tesla engineers develop that software and how the company tested the update to make sure it would actually work, the letter reveals. there have been 20 new crashes since that recall, with more business and tech news, let's turn to silvana now at cnbc. good morning. hey chris good morning to you. our let's start with wall street. it's set for a flat open after the dow rose for a fifth straight day, its longest winning streak since december. and the market's getting some momentum from a fall in yields on treasury

bonds. but that was offset by a drop of nearly 10% in disney shares after the entertainment giant reported disappointing earnings in focus today. for investors, we get more results from the likes of a firm uber, airbnb, tripadvisor and robinhood. ftx customers are in line to recover all the money they lost in the collapse of the crypto exchange, with interest under a new plan filed by the company's bankruptcy lawyers, nearly all of ftx's creditors and regular investors would receive cash payments equal to 118% of the assets they had stored on the exchange. that would come from assets the lawyers have pooled since ftx imploded in 2022. it will still take months for the payouts to start, and movie theaters are still seeing foot traffic well below pre-pandemic levels. data from analytics firm placer.ai shows. visits to amc were down 65% in april versus 2019, and

50% year over year. the declines are similar at cinemark and regal cinemas, and some of the drop can be attributed to theater chains closing some locations and people still watching movies at home. the absence of new blockbusters is also taking its toll. however, moviegoers are more likely to spend on concessions and premium formats like imax, which are more profitable for theaters. kris kris popcorn is. you know, i haven't been to the movie. i haven't been to a movie theater in years. i think i've been once in the last couple of years. yeah, we didn't go before the pandemic. really? yeah. we rented out a movie theater during the pandemic. it was like 99 bucks. yeah, it was the one thing we did over months and months and months. it was fantastic. but wow. still, the popcorn was pricey. wow. nice i sneak it in my purse. oh, boy. guilty. i know, all right. trending this morning. an unusual choice for a wedding venue at eight months pregnant. a woman in florida got married

in the hospital while in labor. that's not what we usually want to do when we're in labor. brianna lucas durazo got sick with rsv, which means that she had to have her baby a few weeks early. so this totally derailed her and her fiance's plans of getting married. the following day, the nursing team at adventhealth jumped into action, sparing no details. not even the dress. and she was like, do you mind if i make you a wedding dress out of bedding sheets? i showed her a picture of the dress that i wanted, and she has all these suture kits in her hand and she just starts cutting everything up, sewing everything together with the with the sutures. and she did it within, like, 20 minutes. like within like 30 minutes. we had a wedding ceremony. what 20 minutes? what? that is unbelievable. i guess one of the benefits of working in surgery, you know, you know how to sew. well, luckily, the expectant mom and had the wedding bands and the marriage certificate in her hospital bag because you have to be ready for everything. and the ceremony did go off without a

hitch. two days later, instead of a honeymoon, lucas durazo and her husband welcomed a healthy baby boy and named him landon. so if you've got a minister there, do you get a package deal? you get like the wedding and the baptism for half price? i mean, how does that work? so, right while you're here, he had a new witness? pretty much. yeah, exactly. get the food. comes in and everything's great afterwards. i mean, nurse reception of the babies. everybody gets jello. yeah. hospital jello. wow yeah. amazing. all right, so, carrie, is starting to warm up. we were working in the yard yesterday. okay, well, if yesterday was warm for you, i'm going back inside next few days. it's going to be much warmer and windy. and so when we see a dry wind coming through, well, our beautiful green vegetation that we have is about to get a lot more crispy over these next few days. take a look at our setup that we have with a lot of clouds and the storm track. well to the north and east of us. it is all clear across the bay area the 7-day

forecast is now coming up at the bottom of the screen. you'll want to check that out. we already have a wide range in temperatures here. we're in the 60s in vacaville, napa and sonoma. those temperatures are already warm because the wind is gusting up there. that makes those temperatures warm up as well. and then where we have a calm wind, temperatures are much lower. we're in the upper 40s in dublin as well as fremont. a wind advisory will be in effect in these areas in the north bay, where we are starting to see those winds increase, and it's going to potentially gusts up to 45mph for today. and it will be coming in from the north and the northeast as we go into the afternoon. but some of those winds may be just enough to bring down some tree branches and cause some issues. we're also going to have a breezy northerly wind across much of the rest of the bay area, but it won't be as high as those areas that will be under that wind advisory through tomorrow morning. temperatures are headed for the low 80s for today, a low 80s as well for the south bay,

while the peninsula will be in the mid 70s. looking at the spike in temperatures, we'll see continuing into tomorrow as well as friday, upper 80s and even a few low 90s in concord. in fairfield, we're going to hit 90 degrees there in walnut creek after the big warm up. we'll see there won't be much of a cooldown until about mother's day, so we are going to have some more well above normal temperatures extending into next week. and mike, you're seeing one major trouble spot out there. yeah, everything else is standard. what you'd expect a little bill for 84 and out of the altamont. a little more traffic, but it's here. highway 24, where we had quite a bit of slowing for about five, almost ten minutes here approaching acalanes road. this crash is in the center divide, and as the tow truck and crew arrived on scene, there was a lot of slowing. i thought the fast lane might be closed. the disturbance, though, is clearing up. they still have work to do so once they have to reenter traffic or clear to the right shoulder, you'll see more slowing. that's fine. right now from the walnut creek

on washington, d.c. for the first ever world fire congress. it's today at the library of congress and they're participating countries. will signed a statement detailing their mission. more than 55 countries are represented in the week long event hosted by the u.s. fire administration and fema. a big focus is on how climate change is shifting, what they encounter on the job. much like we experienced in the united states on the island of maui and lahaina, where this was not a wildland fire. this was a community conflagration that

spread because of the drought condition. and, of course, a fire then, coupled with hurricane force winds. the conference. the conference is also looking at how mental and physical health of the firefighters, who often suffer ptsd or develop cancer because of their work. and you can see more stories on our climate reporting on our website, nbcbayarea.com, and look for this story on the climate in crisis page. thank you. carrie new this morning. may is mental health awareness month, and today we're focused on our teens and tweens in middle school. and this this one hits home. yeah for sure. so a new study by the kaiser family foundation this year shows that our teens and tweens are still struggling with their mental health. 42% of teens who took the survey reported feelings of sadness and hopelessness, but only 20% report getting therapy to improve their mental health and 14% report taking prescription medication for their symptoms. so under under medicaid did

lafayette, a tow truck. so at least it's still a little cooler right now. westbound 24. this crash car hit the center divider , folks, and busted their tires. so they're waiting on that tow truck. westbound may slow down just past happy valley, approaching lanes. once that tow truck arrives. still in route, still seeing a subtle build. highway four, highway 37 just showing the beginning of the morning commute. the bay bridge toll plaza. the sensors just slowed a bit on the incline at the toll plaza itself. smooth, easy drive. we see more cars. those metering lights. 5 or 10 minutes back to you. thank you. mike, we have new developments this morning for san francisco unified, where there is now a plan of action. it comes as the california department of education is taking control over the school district's spending today in the bay's ginger conejero saab live in san francisco and ginger, this is just the beginning of a months long process to figure out what happens next. that's right chris, good morning to you. and that months long process may get

difficult at times. as you mentioned, this is just the beginning. but now a plan is laid out in hopes to fix spending at san francisco unified at last night's meeting, the california board of education specific team, the fiscal crisis and management assistance team. they are the ones who audited sf, usd and created and presented interim reports. they first presented their findings to the school board. no big surprises there. still bad news for the school district, including downgrading the district from qualified certification to negative certification for one of those interim reports, sf, usc has also been assigned fiscal advisors with veto powers on its spending. now, the school district says it has eliminated a significant number of open positions. it is now in that process of identifying which schools will be closed in hopes to save money. the district will also need a hiring freeze. in addition to those school closures, that corrective plan will be in place by the end of

the month. the school will also then have those series of meetings with sfusd families and the communities to really try to make that difficult decision of which schools to close. that vote is expected in december, and kris a silver lining in all this, even listening in to the meeting that happened last night, there's a lot of bad news. but there's also hopeful news. there is now more information and kind of more openness between the district as well as the board of education in making those positive steps, moving forward. that has to be comforting to the parents who have kids in san francisco unified schools. thank you. ginger. well, finally, and at long last, the city of oakland is set to start a new chapter when it comes to the leadership of its embattled police department. yeah, a new permanent police chief is waiting in the wings. a regular today in the bay. anchor laura garcia is in our newsroom, still healing from a nasty case of laryngitis. laura oakland shengtao says she's ready to

move forward. yes, she certainly wants to. for her community, new chief floyd mitchell officially takes the reins on saturday. that's 15 months since the firing of lauren armstrong in oakland. mayor shang tao says it's just the tip of the iceberg when it comes to oakland turning the corner on its recent troubles. i sat down with her virtually to learn more about the future plans for the city, and why she believes things are actually on the way up. and to her, it all starts with lower crime rates overall, crime in the city of oakland is down by more than 30% compared to year to date. last year. specifically, we are seeing reductions in homicides by 17. robberies are slightly up by 6. however that number is starting to flatten out since mid-february. brie now she really credits the crime drop to several things, but has certainly got a big boost when governor newsom greenlighted added assistance from the chp. our ceasefire strategy and in our partnership with chp, it really involves multiple jurisdictions, right? everybody

has to be operating at a high level and functioning together in order for the strategy to work. and we're seeing that it is paying off other priorities going forward include boosting efforts to clean up blight and illegal dumping, even a new tree planting push to bring the magic back to oakland and boost small businesses in the process. the people here in the city of oakland, we love our city and we know that we go through bad times and good times of what have you, but it is nothing compared to what we are seeing consistently, which is consistent negativity. when there are so many great things happening. we have hundreds of new small businesses opening up, and for generations now, our small businesses in the city of oakland is our backbone. she really wants people to come out and support oakland now. the mayor also tells us the incoming chief is already working with opd's interim chief and other department leaders to try to get up to speed on the city's new crime fighting strategy. still, the goal continues to be not just flattening those crime rates, but eliminating them

altogether. guys, good luck with the voice, laura. all right, turning now to capitol hill, where house republicans are holding a hearing looking into accusations of anti-semitism in elementary and secondary schools. district leaders from all over, including berkeley, new york city and suburban dc, are expected to testify. the panel includes the berkeley school superintendent, republicans say the hearing will focus on students accused of making anti-semitic comments and lesson plans, demeaning israel. new overnight the pro-palestinian encampment at george washington university in washington, dc is now empty. police cleared students out of their tents early this morning. police say they arrested at least a dozen protesters. at least two officers pepper sprayed protesters while trying to clear the encampment right now, a small group of protesters has gathered outside the police department to demand the release of those who were arrested. israel's new incursion into rafah is the focus of dual protests on uc berkeley's campus , also the stanford campus, all of it coming with tensions

already on a knife edge in the middle east and hope fading on that israel and hamas cease fire deal. hands up now! hands off for now, palestinian supporters fear new problems in gaza with israel gaining control of the key border crossing in rafah, which also serves as the key entry point for humanitarian aid at cal sproul plaza. hundreds of people gathered for yesterday's rally. as the size of the berkeley encampment grows larger , with spaces now in place for both alumni and union workers. palestinian supporters at stanford, meanwhile, held what they called an all out for rafah rally in both protests, activists maintained the call for divestment from israel. happening today. an east bay school board mired in controversy might vote on the fate of its embattled district superintendent. the controversy stems from a story candace nguyen in nbc bay area's investigative unit first brought to light. it surrounds

allegations that antioch schools maintenance director ken turnage bullied and harassed workers, including a claim he moved an employee's desk to a rooftop. you can see it there as punishment. turnage is now on administrative leave in the wake of our team's report. the allegations also include what some claim is a cozy relationship with antioch school superintendent, who has since recused herself from leading any investigations. again, the board president tells us tonight he plans to call for a vote to remove the superintendent. previously, neither the superintendent nor turnage would respond to our requests for comment. you can watch our previous investigative unit stories on a special section of our home page, nbcbayarea.com kris i new this morning stanislaus county prosecutors are reportedly shooting down a request from la's innocence project to conduct new dna tests to try to earn a new trial for scott peterson. peterson's team is making that request as part

of a series of hearings surrounding that possible new trial. peterson is serving life in prison for the murder of his wife, laci, and their unborn son more than 20 years ago. his attorneys hope to retest evidence, including a mattress that was found in a van in the peterson's neighborhood, the modesto bee reports. prosecutors responded last week claiming previous testing not only rules out laci's dna, but matches a male profile, not that of a woman. the new response also calls the latest hearings a fishing expedition in search of a boat. the next hearing is scheduled for may 29th. okay, we are lucky. the weather is great here, but there is severe weather hitting the central us right now. this time it's michigan and ohio cleaning up after severe storms swept through. and these are tornadoes, not just winds, right? and we've had over 300 tornadoes in the month of april. this was the second most active on record. and it just continues into may, due in part from el nino as well as climate change.

and yesterday it was michigan that took the brunt of those storms and all of those tornadoes. look at this video from the city of portage, about 140 miles west of detroit. well, that's where a suspected tornado took direct aim at this mobile park home and destroyed multiple homes. and you can see the span of all of that damage there. people were moved to shelters over the last night, and thousands now remain without power this morning. meanwhile also in the small michigan town, a tornado ripped off the side of the fedex facility there, trapping 50 workers at one point. and rescuers raced to clear power lines that blocked to block their exit. to get out of the path of that tornado. and in ohio, severe storms rolled through the state. there over the past 24 hours. this video from greenville, about 33 miles northwest of dayton, and that severe weather, downed power lines as well as trees that blocked the streets. and those trees also fell into homes. there were also reports of damage left behind by flooding. more than a thousand people

there remain without power. this morning, and we can see all of that damage there as more storms are developing in that region, and we are still seeing a very active severe weather situation this morning. we are seeing a cluster of storms moving through montana. and then we're also getting now a severe thunderstorm watch for parts of missouri. and then seeing those storms also pushing off to the east. so the possibility of more tornadoes expected today as we are getting a clear sky. but it's going to be ramping up here with the heat as high pressure builds. so we'll talk more about how hot it gets. and mike, you predict that those metering lights at the bay bridge did carry. but i'm not psychic. i'm just a veteran of the bay area commute. we have the backup of the metering lights. 536 this morning. there we go. that's the exact time they were turned on, but the backup continues to form and build here. a little slowing on the incline. 37 highway for standards slowing there as well. a note today, a double headers so you'll have a noon game and then a 4:00 game over here by the coliseum. exchanging traffic

clouds and seeing that? no. this time of year, it's all clear. looks great. yeah, yeah. so we're starting out this morning. also clear. and we're going to see those temperatures heating up today. take a look at our live view in walnut creek as you're heading out on this wednesday morning. and we've had some cool temperatures. but it is going to be heating up today along with some gusty winds. all of these areas shaded in this light brown will be under a wind advisory already in effect. that continues until tomorrow morning, and we'll see a northerly wind coming in at about 15 to 25mph, but may gusts up to 45mph for some of those hills. and we could also see the potential of some downed trees and impacts to a few spots with power outages. look at our hour by hour wind forecast. we're taking it to 1:00 this afternoon. you can see those winds coming in 25 30mph. but we're also going to see that around some of our hills in the east bay. mount diablo 30 mile per hour winds. and it's expected to continue as we go

throughout the day near the coast, as well as in some of our valleys. also a breezy afternoon as those temperatures warm up, it's going to feel more like a hairdryer outside. and that of course, will dry out all of our beautiful green vegetation that we have as we've accumulated all of that rain throughout the winter season. but now we're in the low 50s in castro valley, and as we go throughout the day, we're going to see those temperatures headed for the low to mid 70s in the early afternoon today, the warming trend begins with some low 80s in the south bay. but then look at tomorrow. we're headed for the upper 80s in the north bay, the inland east bay, as well as the south bay. and it's going to continue to be hot throughout the weekend into early next week. so we're settling into a new pattern with some high temperatures in the 80s in the inland valleys. and that includes our mother's day. if you're going out for brunch or whatever you have planned, you might want to bring a little fan, too. it's going to be quite warm. and mike, you're looking at a quick build up at the bay
